Conference: "Public and Private Corruption: a new discipline"

Over 90 professionals gathered at Palazzo Matteotti for the conference "Public and Private Corruption: a new discipline", organised by Studio Cagnola & Associati and by Studio Perrroni & Associati, with TopLegal as media partner.

A topic that is nothing short of crucial, not only of legal importance but also socio-cultural, and above all, with a considerable economic impact for Italy. The conference retraced reforms aimed at tackling corruption, focusing on the relevant actions carried out under L. 3/2019, the so-called Spazzacorrotti, or "Bribe destroyer", law.

The new provisions introduced by L. 3/2019, inspired by measures relating to the fight against the Mafia, drug trafficking, and other forms of organised crime, pursue the general aim of increasing the likelihood of conviction as well as the level of effectiveness of the penalty.

The conference hosted contributions from, in the following order, Fabio Cagnola, lawyer, Founding & Managing Partner Cagnola & Associati; Riccardo Lucev, lawyer, Senior Associate Cagnola & Associati; Dr Carlo Nocerino, Assistant Public Prosecutor at the Court of Brescia; and from Giorgio Perroni, lawyer, Founding & Managing Partner Perroni & Associati. 

Providing a full overview of the amendments introduced by L. 3/2019, material as well as investigative and procedural, the experts extensively discussed the more controversial aspects of the legislation: from the reform of the statute of limitations to the introduction of crimes against the public administration into the catalogue of impeding offences (art. 4-bis Penitentiary System) in relation to which the suspensive mechanism of the execution of the penalty does not operate (656 Code of Criminal Procedure),and from the new case of exemption from criminal liability for the bribe taker who voluntarily discloses the bribery arrangement (art. 323-ter Penal Code) to the extension of the hypotheses in which the interception of communications between those present by means of technological devices is allowed.

The conference concluded as usual with an interesting opportunity for reflection on, and open discussion of, the topics addressed.
